THIS CRIMINAL PETITION FILED U/S.439 CR.P.C PRAYING TO ENLARGE THE PETITIONERS ON BAIL IN CR. NO.220/2012 OF GUNDLUPET P.S., CHAMARAJANAGARA, FOR THE OFFENCE P/U/S 420 OF IPC. THIS CRIMINAL PETITION IS COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:ORDER One V.Anthony Joe Raja, Chief Executing Officer of S.Prime Group of Companies of Chennai lodged the complaint with the jurisdictional police alleging that petitioners and others collected a sum of Rs.17,00,000/towards stamp duty and other charges for executing certain registered deeds and cheated the company. The jurisdictional police registered a complaint in Crime No.220/2012 for the offence punishable under Section 420 of IPC.

2. The investigation is completed and charge sheet is filed. The petitioners are accused Nos. 4 and 5. No circumstances are made out for continuance of the petitioners in custody. The apprehension in the mind of

the respondent-police that the petitioners may tamper with the prosecution witnesses is to be protected by putting the petitioners on some terms.

3. For the reasons stated above, the following: ORDER The petition is hereby allowed. The petitioners are enlarged on bail on the following conditions:-

i)

The petitioners to execute a personal bond for a sum of Rs.1,00,000/- each (Rupees One Lakh only) with two local solvent sureties for the likesum to the satisfaction of the trial Court.

ii)

The

petitioners

shall

not

leave

the

jurisdiction of the trial Court without prior permission from it. iii)

On all hearing dates, the petitioners shall appear before the trial Court.

iv)

The petitioners shall not in any manner tamper with the prosecution witnesses.

Violation of any one of the conditions above will result in cancellation of bail order. Ordered accordingly.
