Workshop on the County's appeal procedures

RECOMMENDATION County Counsel requests that the Board hold a workshop on the County's appeal procedures, including: 1. 2.

Receipt of staff report on the County's current appeal procedures; and Discussion and possible direction for code amendments to clarify and simplify the appeal procedures.

EXECUTIVE SUMMARY Over the years, Napa County Code has been periodically amended on an as-needed basis. In recent months, several building and land use appeal cases have highlighted the need for the County to review its code in its entirety in order to clarify the procedures and to streamline the appeal procedures. This workshop is intended to provide information on the County's current appeal procedures and obtain Board input. After the workshop, staff plans to conduct community outreach to obtain additional input from the public and also stakeholder groups. As a result of discussions at the workshop and public input from the community, staff will bring back recommended Code amendments to the Board for its consideration and possible adoption at a future date. ENVIRONMENTAL IMPACT ENVIRONMENTAL DETERMINATION: The proposed action is not a project as defined by 14 California Code of Regulations 15378 (State CEQA Guidelines) and therefore CEQA is not applicable.

BACKGROUND AND DISCUSSION Over the years, Napa County Code has been periodically amended on an as-needed basis. In recent months, several building and land use appeals have highlighted the need for the County to review its code in its entirety in order to clarify the procedures and to streamline the appeal procedures. The goals for reviewing and amending the County's appeal procedures are: ● ● ●

To safeguard the parties' procedural due process rights; To streamline the process to avoid costly delays and redundancies; and To ensure the appeal requirements are clear, consistent, and easy to understand.

This workshop is intended to provide information on the County's current appeal procedures and obtain Board input. After the workshop, staff plans to conduct community outreach to obtain additional input from the public and also industry stakeholder groups. As a result of discussions at the workshop and public input from the community, staff will bring back recommended Code amendments to the Board for its consideration and possible adoption at a future date.
