BAHAGIAN 2 : TERMA DAN SYARAT / SECTION 2 : TERMS AND CONDITIONS CONDITIONS OF SUPPLY FOR NON-DOMESTIC CONSUMER

DEFINITIONS 1

CONNECTED LOAD CHARGE (CLC) A chargeable Maximum Demand (MD) when the actual MD measured in any one month does not reach 75% of the declared MD.

CONNECTION CHARGES To pay to SESB a Connection Charge in full (if any) and such payment to be paid before any work is. commenced by SESB, as provided by Electricity Supply Act 1990.

CONTRACT Comprising the Contract of Electricity Supply, Non Domestic Electricity Supply Application Form and Undertaking and Indemnity Letter.

ELECTRICITY SUPPLY Either permenant or temporary electricity supply subject to the consumers application to SESB.

HIGH VOLTAGE (HV) In the context of tariff classification means a supply voltage of 66,000 volts and above.

INSTALLATION The whole of any plant consists of primary and secondary equipment designed for the supply or to generate or to use of electricity including prime movers with all necessary plant, buildings and land in connection therewith pipeline, supply line and consuming apparatus in accordance with the Electricity Supply Act 1990 and its regulations made thereunder and modification made thereto.

LIQUIDATED DAMAGES (LD) A sum of money chargeable to the Consumer who fails or ceases to take supply for three (3) years after signing of this Contract.

LOW VOLTAGE In the context of tariff classification means a supply voltage not exceeding 1,000 volts.

MEDIUM VOLTAGE (MV) In the context of tariff classification means a supply voltage from 11,000 volts to 33,000 volts.

MINIMUM MONTHLY CHARGE (MMC) A monthly charge applicable to a Consumer in the event his monthly total electricity bill (kW and/or kWh) is less than the stated amount as stipulated in the Tariff Structure and Rate.

NON DOMESTIC CONSUMER A person and/or entity who is registered and entered into this Contract with SESB (the details are specified in the Application Form) other than domestic consumers and supplied with electricity or whose premises / occupied premises are at the material time connected for the purpose of supply of electricity from SESB’s installation subject to rules and conditions imposed by SESB and Electricity Supply Act 1990 and its regulations made thereunder.

PROJECT MINIMUM MONTHLY CHARGES (PMMC) Imposition on Consumer in order to ensure the capital invested by SESB in supplying electricity to the Consumer gives the minimum revenue required.

REGISTERED ELECTRICAL CONTRACTOR Person holds a valid certificate of registration as an electrical contractor issued under Electricity Regulations 1994.

SESB Sabah Electricity Sdn Bhd (462872-W) a company incorporated in Malaysia under the Companies Act 1965 with its registered address at Wisma SESB, Jalan Tunku Abdul Rahman, 88673 Kota Kinabalu.

STATUTORY AUTHORITY Any prevailing Government and/or statutory bodies and/or agency who acts as statutory authority established under the relevant Acts.

TARIFF The rates to be charged to the Consumer for the consumption of electricity as stipulated under Section 6 of the Application Form, as provided by the Electricity Supply Act 1990 and approved by the Government of Malaysia from time to time.

A.

CONSUMER’S COVENANT

1.0

TO TAKE SUPPLY To take supply from SESB at the Consumer’s premises at the determined Tariff structure and rates and pursuant to the provision of the Electricity Supply Act 1990 and any modification thereof.

2.0

MEDIUM VOLTAGE OR HIGH VOLTAGE SUPPLY The Consumer who applies the medium voltage or high voltage supply shall have to pay Connection Charge subject to the prevailing policy of SESB’s connection Charge and Tariff, additional PMMC and LD, if any.

3.0

CONNECTION CHARGE To pay SESB the Connection Charge in full (if any) and such payment to be paid before any work is commenced by SESB as provided in the Electricity Supply Act 1990.

4.0

DEPOSIT a) Consumer shall pay the required deposit to cover the estimated charge for two (2) months monthly electricity consumption before the supply is connected, provided that SESB shall have the right to revise the amount of required deposit from time to time. b) The Consumer may opt to provide the required deposit by way of bank guarantee or cash. In the event the Consumer opts to provide for bank guarantee and fails to renew the bank guarantee upon expiry date, SESB shall have the right to disconnect the supply to the Consumer’s c) premises. In the event the Consumer applies for temporary supply, however subject to SESB’s approval, the Consumer shall pay the required deposit to cover the estimated charge for six (6) months monthly electricity consumption before the supply is connected, provided that SESB shall have the right to revise the amount of required deposit from time to time. d) In the event the Consumer fails to increase the deposit amount as advised by SESB upon revision on the deposit stipulated in Clause 4.0 (a)or(c) above, SESB shall have the right to disconnect the supply to the Consumer’s premises. e) The required deposit shall be a security and not a payment in advance and shall not relieve the Consumer from any liability to pay the monthly electricity bill and any other charges due and payable by the Consumer to SESB. f) SESB shall pay to the Consumer subject to such conditions and at such rates as may be prescribed by the Statutory Authority, a sum equivalent to the annual interest on the cash deposit only as a rebate. g) Upon termination by either Party SESB shall refund the deposit to the Consumer after the deduction of any amount due and payable by the Consumer to SESB.

5.0

MINIMUM MONTHLY CHARGE Consumer agrees to pay SESB the Minimum Monthly Charges commencing from the supply of electricity to the Consumer’s premises.

6.0

ACCESS The Consumer agrees with SESB that the authorized employees, agents, contractor and/or representatives of SESB shall be permitted to have access to the premises of the Consumer at all reasonable time in any manner howsoever under any circumstances whatsoever:a) To carry out their duties and/or inspection and/or test and/or construction and/or other things relevant to the supply and disconnection to the Consumer’s premises. b) To permit SESB to cut down any trees on Consumer’s property or premises for the purpose of safety, clearance or maintenance of the service lines to Consumer premises from time to time without any compensation from SESB.

7.0

NO INTERFERENCE OF SUPPLY TO OTHER CONSUMERS The Consumer agrees to use electricity supply so as not to interfere with the supply of electricity to any other Consumers.

8.0

UPKEEP AND MAINTENANCE OF SESB’S INSTALLATION Consumer agrees; a) to upkeep the SESB’s installation and to take steps to ensure that no damage occurred to the said installation. b) to allow SESB including its authorized employees, agents, contractor and/or representatives of SESB to maintain any electrical installation within the Consumer’s premises at any time for safety purpose. c) if there is any defect or abnormality on the installation, SESB shall have the right to make good the defects without being liable for any damages whatsoever unless proven otherwise.

9.0

NO OBSTRUCTION TO SESB’S INSTALLATION a) The Consumer shall not create any obstruction and/or commence any activity in the vicinity of any SESB’s installation and/or place any equipment which may endanger life or properties. b) SESB has the right to take any reasonable action to remove any obstruction created by the Consumer or representatives and/or his agent and/or any other person under Consumer’s supervision/control. c) SESB shall not be liable to pay any compensation for any losses and/or damages to the Consumer due to the said removal.

10.0

TERMINATION BY THE CONSUMER a) The Consumer may terminate this Contract by giving written notice to SESB at least three (3) working days and delivered in the manner stipulated in Clause 32.0 in this Contract. b) Any termination of supply shall not discharge the Consumer for all obligations and liabilities including any claim or any other charges imposed by SESB prior to such termination.

11.0

DISCONNECTION FEE The Consumer will be charged by SESB with an appropriate fee in the event as follows:a) If the electricity supply is disconnected from the Consumer’s premises due to failure to pay electricity bill or additional amount of deposit; or b) If the electricity supply is disconnected from the Consumer’s premise due to change of Consumer and change of Tariff; or c) If the electricity supply is disconnected from the Consumer’s premise due to failure in renewing the Bank Guarantee which has been expired. d) Upon occurrence of any Event of Default prescribed in Clause 23.0 herein.

12.0

VACATION OF PREMISE a) If the Consumer vacates or quits the premise without giving a minimum three (3) days written notice to SESB, the Consumer shall be liable to pay all charges in respect of the supply of electricity to the premises accruing until the installation is disconnected and terminated or new Consumer applies for electricity supply to that premise and enters into a new Contract with SESB. b) SESB shall have the right not to provide new electricity supply to any premises until the aforesaid Consumer has made the full payment of the outstanding electricity bill.

13.0

RESPONSIBILITY TO MAKE GOOD ALL DAMAGE The Consumer shall pay for all damages to SESB’s installation within the Consumer’s premises or due to Consumer’s negligence or any persons under the Consumer’s control or supervision.

14.0

APPLICANT DECLARATION The Consumer shall be bound and abide at all times to the Applicant Declaration as stipulated in Section 1 of the Application Form, the conditions of this Contract, the Electricity Supply Act 1990 and any rules and regulations and amendment made hereunder.

B.

SESB COVENANT

15.0

LOCATION OF INSTALLATION a) SESB shall determine the position of the end connection of entry route of the service lines or cables including cut-out fuses, meters and others to the Consumer’s premises. b) In the event the Consumer or owner of the premises wishes to remove or relocate the SESB’s installation within or outside the Consumer’s premises, authorization of SESB must be first obtained and all costs of removal or relocate shall be fully borne by the Consumer or the owner. Any removal or relocation made without written authorization shall entitle SESB to disconnect the supply without any notice.

16.0

USAGE OF INSTALLATION FOR OTHER CONSUMERS SESB may use part of its installation to supply electricity to other Consumers in the area.

17.0

INSPECTION BY SESB a) SESB may need to inspect and test all installation before connection of supply. However, it is the responsibility of the Registered Electrical Contractor to ensure that the installations are safe to use. b) Consumer shall inform SESB of any proposed extensions or alterations to the installations so that SESB may make inspection and test of the proposed extension or alteration if SESB so desires. c) SESB shall not be liable for any loss or damage caused by or occurs during or after test due to any defect in the installation. Any test carried out by SESB is for SESB’s purposes only and does not imply any warranty that the installation is suitable for the Consumer’s purposes or that it fully complies with the Electricity Supply Act 1990 or any rules and regulation made thereunder.

18.0

TEMPORARY SHUTDOWN OF SUPPLY a) SESB may temporarily shutdown the electricity supply for purposes of maintenance, testing, inspection or any other purpose whatsoever connected with the proper working of or in relation to SESB’s duties to provide electricity supply or reasonable requirement of SESB system by giving at least forty eight (48) hours prior written notice by way of personal or substitute services before the intended temporarily shutdown. b) SESB is not under obligation to provide alternative source of supply during such shutdown.

C.

IT IS HEREBY AGREED BY BOTH PARTIES

19.0

RISING AND LATERAL MAINS (a) For single individual premises, the part of the installation, comprising service lines and other ancillary equipment up to and including the meter shall be the property of SESB. (b) For multitenant premises where part of the supply is intended for including but not limited to the owner, developer, management or landlord and the rest for the tenants in the building, the landlord’s supply and each of the tenants will have its own electricity bill by SESB. The owner, developer, management, landlord or their respective agents shall provide, own, maintain and repair at his own expense the electrical systems in the buildings including adequate and necessary rising and lateral mains. The design, installation and operating of such electrical systems shall comply with the requirements of all the relevant Statutory Authority and SESB’s requirements.

20.0

TEMPORARY SUPPLY If the Consumer or the owner of premise applies for temporary electricity supply is allowed and approved with the conditions by SESB, the Consumer or the owner of premise will be charged according to the tariff rates as stipulated in Section 6 of Application Form Electricity Supply Contract on its total monthly bill.

21.0

BILLING AND PAYMENT a) All electricity bills rendered by SESB to the Consumer shall be paid by the Consumer within the stipulated period mentioned in the electricity bill. b) Notwithstanding anything hereinbefore mentioned, SESB shall have the right to impose Minimum Monthly Charge as stipulated in Tariff structure and rates. c) SESB shall have the right to impose surcharge of one percent (1%) monthly on the outstanding amount calculated until the date of full payment. d) The Consumer shall be liable for the electricity bills issued by SESB insofar as the account is registered under the Consumer even the consumption of electricity is by any third party. e) The Consumer shall be responsible to repay the amount in the electricity bills rendered by SESB including any other relevant charges for any invalid payment made by the Consumer through false credit card, bounce cheque and any other invalid payment. f)

In the event the Consumer fails to make payments on the amount as per Clause 21 (a),(b) and (c) hereof, SESB shall have the right to disconnect electricity supply of the Consumer’s premise or any other premises which is registered under the Consumer’s name. g) The Consumer shall be liable for any arrears of electricity bill and/or loss suffered by SESB by reason of dishonest consumption of electricity supply in all circumstances. h) SESB shall have the right to make adjustment and update of Consumer’s account whenever necessary.

22.0

REMOVAL OF SESB’S INSTALLATION If the Consumer or the owner of the premises requests SESB to remove or relocate the SESB‘s installation within or outside the Consumer’s premises, subject to consent by SESB first had and obtained, all costs of executing the removal or relocation shall be fully borne by the Consumer or the owner as the case may be.

23.0

EVENT OF DEFAULT The occurrence of any one of the following shall constitute an event of default under this Contract and it is not limited to: a) Act or default of the Consumer affecting the efficiency and/or safety of SESB‘s installation; b) The Consumer has failed to comply or breach with any of such provisions in this Contract and/or the Electricity Supply Act 1990 and any rules and regulations made thereunder and subsequent amendment made thereto; c) In failure or refusal or negligence of the Consumer or the Consumer’s guarantor in presenting the Bank guarantee in accordance with SESB’s bank guarantee’s format as provided; d) The Consumer has obtained consent for the appointment of or the taking of possession by a receiver or liquidator of itself or of all or a substantial part of its property; e) The Consumer acknowledges in writing its inability to pay its debts as such debts become due; f)

g) Instituting a case voluntarily or filing a petition against any party seeking for benefit of any law relating to bankruptcy, insolvency, reorganization of its debts, winding up or composition; h) The Consumer is under receivership or under special administration or liquidation; i)

The consumer is declared bankrupt or wound-up or liquidated by the Court;

j)

Upon the Consumer dissolution or death;

k) Failure to pay the electricity bills and whatsoever as stipulated under Clause 21.0 above; l)

Consumption of electricity in any dishonest manner;

On such effective date of termination hereof, SESB shall be discharged from any obligations and liabilities under this Contract including any claim for damages without prejudice to SESB’s rights to make such claim due to the disconnection of the supply and the termination of this Contract. 24.0

DISCONNECTION OF SUPPLY SESB shall have the right to disconnect the supply without giving prior written notice in any situations mentioned below:a) Any default by the Consumer under Clause 23.0 above and such default are not remedied within the stipulated period, if any. b) By court order / Judgment. c) If in the opinion of SESB that the continuation of the supply will jeopardize the safety, reliability or security of SESB‘s system or presents an imminent physical threat or endanger the safety, life or health of any person. d) Any right to disconnect the supply without notice as provided under the Electricity Supply Act 1990, its rules and regulation made thereunder and subsequent amendment made thereto.

25.0

TERMINATION BY SESB a) SESB may terminate this Contract at any time upon giving not less than seven (7) working days notice in writing of its intention to do so. b) SESB may terminate this Contract upon the circumstances stipulated under Clause 24.0 above except for the event of default in Clause 23.0 (a), (b) and (c) of this Contract where the termination shall effect from the date of expiry of the remedy period. c) If the Consumer renders to SESB a temporary notice of disconnection of supply thereby it shall be considered as a notice of termination of the Contract subject to the issuance of notice under Clause 25 (a) hereof. d) If SESB discovers that the information given by the Consumer is false and/or is disputed with the existence of prima facie proof relating to the supply, SESB shall have the right to terminate this Contract upon giving a written notice of not less than 24 hours.

26.0

FORCE MAJEURE SESB shall not be liable to the Consumer for any breach of terms and conditions of this Contract due to any of this event which shall include but not limited to national emergency, war, hostilities, riot, civil commotion, earthquake, flood and disposition or fire accident that may occur in consequences of the supply or the use or misuse thereof which does not result from SESB's negligence or by compliance with any order of government, local or any other relevant authorities.

27.0

TRANSFER OF OUTSTANDING AMOUNT AND BALANCE DEPOSIT a) SESB shall have right to transfer any outstanding amount of electricity bills from any inactive account of the Consumer to any active account registered under the Consumer’s name. b) If there is any balance of the deposit from an inactive account of the Consumer, SESB shall have the right to use the balance of the deposit for the purpose of: i) Offsetting any outstanding amount/charges for the inactive accounts. ii)

28.0

For any active account, balance of deposit from inactive account can be transferred to any active account of the Consumer, if any.

LIQUIDATED DAMAGES In the event the Consumer fails or ceases to take supply for three (3) years after signing of this Contract, the Consumer shall pay Liquidated Damages to SESB. Provided always that the amount and the payment of Liquidated Damages shall be subjected to the prevailing policy of Connection Charges and Tariff.

29.0

CONNECTED LOAD CHARGE The Consumer may be required to pay a Connected Load Charge (if any) when taking supply at medium or high voltage based on the prevailing policy of Connection Charges and Tariff.

30.0

POWER FACTOR The Consumer shall at all times use its best endeavor to obtain the highest power factor possible close to unity power factor lagging in the operation of the Consumer’s electrical installations. A penalty shall be imposed based on the prevailing rates as approved pursuant to the Electricity Supply Act 1990 its rules and regulation made thereunder and subsequent amendment made thereto if the power factor in any month falls short of the minimum power factor set under the existing SESB Tariff Book.

31.0

INDEMNITY AND NO LIABILITY CLAIM a) The Consumer agrees to indemnify and keep indemnified (indemnifying) SESB from and against all and/or any claims, actions, compensations, suits, proceedings, demands and all legal costs incurred thereby, brought against SESB, its servants or agents by a third party to which SESB shall or may be or become liable in respect of or arising from the performance of this Contract. b) The Consumer hereby agrees that neither SESB nor its employees, servants, agents, representatives shall be liable and/or make good the Consumer in respect of any damage, injury or loss to any of the Consumer‘s property and/or life unless such damage, injury or loss have been proven as a result of any willful act, negligence, omission and/or failure to comply with any safety measures as provided under any written law. c) The Consumer hereby agrees further that SESB shall not be liable for any cost incurred, loss and/or damage of industrial goods, product, property or life of the Consumer as a result of any unavoidable accident, voltage fluctuation, interruption, reduction and/or cessation of the electricity supply, fire or accident that may occur in consequence of the supply or the use or misuse which is not due to the negligence or willful act of SESB and/or its employees.

D.

MISCELLANEOUS

32.0

NOTICE Unless and otherwise provided under the Electricity Supply Act 1990, its rules and regulations made thereunder and any clause stated under this Contract, any notice, demand or other communication which is required or allowed to be given or made under this Contract shall be in writing and shall be served and deemed to have been duly received as follows:i.

If by hand delivery , duly acknowledged or at the time of such delivery;

ii.

If by way of prepaid registered or ordinary post, upon the expiry of three(3) working days from the date of posting;

iii. If by facsimile transmission, upon receipt of transmission confirmation slip indicating that the notice has been transmitted in its receiver’s facsimile number. 33.0

SERVICES OF LEGAL PROCESS The services of any legal process shall be by way of prepaid registered post sent to the address as stated in this Contract. Proof of posting will be regarded as proof of acceptance and the said services shall be deemed to have been duly served and duly received upon the expiry of five (5) days from the date of posting.

34.0

GOVERNING LAW This Contract shall be governed by and construed in accordance with the Electricity Supply Act 1990 and any regulations made thereunder including any modification thereof.

35.0

AMENDMENT AND MODIFICATION SESB may introduce new terms, amend or modify existing terms of this Contract from time to time, and such new, amended or modified terms, to the extent not inconsistent with the Electricity Supply Act 1990 and any regulations made thereunder, shall be deemed incorporated into this Contract.

36.0

ASSIGNMENT The Consumer shall not assign any of the rights or obligations arising under this Contract to any third party without the prior consent in writing of SESB.

37.0

WAIVER Knowledge or acquiescence by SESB of or in breach of any of the conditions or covenants herein contained shall not operate as or be deemed to be waiver of such conditions or covenants or any of them and notwithstanding such acknowledge or acquiescence, SESB shall be entitled to exercise its rights under this Contract.

38.0

TIME PERIOD Time wherever mentioned shall be the essence of this Contract.

39.0

SUCCESSORS-IN-TITLE This Contract shall be binding upon the successors-in-title and permitted assigns of the respective Parties hereto.

40.0

STAMP DUTY The stamp duty in respect of this Contract shall be borne and fully paid by the Consumer.

41.0

SEVERABILITY If any one or more of the provisions or part thereto contained in this Contract should be or become invalid or unenforceable due to whatsoever reasons this shall not in any way affect or impair the validity or enforceability of the remaining provision hereof.

42.0

INSTALLATION OF EQUIPMENT TO GENERATE ELECTRICITY The Consumer shall inform SESB on any equipment installed at his premise for the purpose of generating electricity.

43.0

POWER QUALITY The Consumer shall use its best endeavor to ensure all its electrical installations have sufficient ride-through capability against slight voltage transient and shall not generate other significant power quality voltage signatures that might have detrimental effects to the electrical supply system.

CONFIDENTIAL INFORMATION Except as it is or becomes a part of the public domain, all information provided by either Party under this Contract shall be confidential at all times unless specified otherwise in writing.

ON-SITE TECHNICAL WORKS a) In the event that SESB is unable to commence and/or complete the installation caused by insufficient and/or inaccurate information under Section 4 of this Contract given by the Contractor, the Consumer shall ensure the same is remedied within two (2) days from the date of the said notification. b) In the event of failure to make good and remedy as above, SESB shall reserve the right to cease electricity supply and/or terminate this Contract.

46.0

DATA PROTECTION The consumer hereby agrees and consented to SESB or its agenst to collect, to keep, to record and to disclose the personal data which under the control and/or safe keeping of SESB for the purpose of processing the electricity supply application/ Tariff review/ Wiring guideline guideline scheme for rural areas with SESB and any other related matters which is in line with the law.

47.0

1) GOODS AND SERVICES TAX (“GST”) a) This clause shall only apply upon the implementation date of the GST legislation in Malaysia. The parties acknowledge and agree that this clause may be subsequently revised to be in compliance with the prevailing GST legislation at the material time. b) All amounts stated in this Agreement are exclusive of GST, unless otherwise clearly stated that they are intended to be GST inclusive. c) The parties acknowledge and agree that if GST is imposed on any supplies made by the supplier under this Agreement, the supplier shall have the right to increase the consideration payable on the supply by an amount equal to the GST imposed. The supplier shall be entitled to recover the increased amount from the recipient of the supply as if the same were part of the consideration of the supply. d) The consideration for such supply shall be increased by an amount calculated as follows: A x R Where: A is the consideration payable for the supply; and R is the applicable rate of the GST prevailing at the time of supply (hereinafter referred to as the “GST Amount”) e) The recipient shall pay the GST Amount at the same time and in the same manner as the consideration for the supply provided under this Agreement. f) The tax invoice, which shall be in the form of a full or simplified tax invoice as per the prevailing GST guide at the material time, to be issued after the imposition of GST and the receipt or any other documents to be issued after the payment for the supply by the supplier to the recipient shall identify the amount of GST payable. g) If a party must reimburse the other party for a cost or expenses, the amount to be reimbursed shall be calculated net of any GST input tax credits that the party seeking reimbursement is entitled to in respect of the cost or expense incurred.

In order to further protect SESB’s interest, the Team also has agreed that it is pertinent to incorporate a saving clause on other taxes or levies which might be imposed by law in future in all SESB’s supply contract. However, please take note that this Other Taxes Clause shall only be applicable when SESB is the party who is supplying the goods or services, not otherwise. This Other Taxes Clause shall not be incorporated when SESB is the acquiring party. Kindly find below the agreed Other Taxes Clause which to be incorporated only in SESB’ supply contracts.

2) OTHER TAXES AND LEVIES Except as provided for otherwise, the Customer/Consumer shall be responsible for all present and future taxes, duties, levies, and other similar charges including any related interest and penalties, howsoever designated (hereinafter referred to as “Other Taxes”), arising out or in connection with the supply of any kind imposed by law.

*Kami/saya juga bersetuju dan berakujanji bahawa *kami/saya tidak akan menuntut daripada SESB apa-apa kerugian yang dialami oleh pihak *kami/saya akibat daripada pemberhentian perkhidmatan bekalan elektrik dan/atau penamatan Akaun Kontrak Bekalan oleh SESB seperti yang dinyatakan pada Klausa 2 di atas.

*Kami/Saya juga bersetuju dan berakujanji akan menanggung dan/atau menggantirugi segala kos perbelanjaan, gantirugi dan/atau sebarang kerugian yang ditanggung oleh SESB terhadap apa-apa tuntutan dan/atau dakwaan daripada pemunya sah Premis tersebut dan/atau manamana pihak kelak yang timbul akibat daripada pemberian perkhidmatan bekalan elektrik oleh SESB dan/atau pendaftaran akaun baru di atas nama *kami/saya bagi Premis tersebut.

*Kami/Saya juga bersetuju dan berakujanji untuk menjelaskan apa-apa bayaran termasuk amaun bil elektrik dan apa-apa caj berkaitan yang dikenakan oleh SESB bagi perkhidmatan pembekalan elektrik di Premis tersebut sehingga tarikh Akaun Kontrak Bekalan ditamatkan samada bagi akaun Kontrak Bekalan tetap atau Bekalan sementara.

*Kami/Saya juga bersetuju dan berakujanji untuk membenarkan SESB membuat pemindahan apa-apa tunggakan amaun atau caj-caj berkaitan perkhidmatan pembekalan elektrik daripada akaun *kami/saya yang telah ditutup atau ditamatkan kedalam Akaun Kontrak Bekalan atau mana-mana akaun *kami/saya yang masih aktif dengan SESB.

*Kami/Saya juga bersetuju dan berakujanji untuk membenarkan SESB menggunakan deposit Akaun Kontrak Bekalan atau mana-mana Akaun Kontrak Bekalan *kami/saya yang masih aktif dengan SESB untuk menolak dan/atau membayar apa-apa tunggakan amaun atau caj bagi akaun *kami/saya yang telah ditutup atau ditamatkan. Sekiranya terdapat pengurangan deposit bagi Akaun Bekalan Kontrak disebabkan penolakan dan/atau pembayaran apa-apa tunggakan yang berkaitan maka *kami/saya bersetuju untuk menambah jumlah deposit tersebut menurut jumlah yang dinyatakan oleh SESB.

*Kami/Saya juga bersetuju dan berakujanji akan menanggung apa-apa kerugian atau perbelanjaan termasuk kos guaman SESB dalam menguatkuasakan Akujanji dan Tanggungan Rugi ini di mahkamah.

Klausa-Klausa di dalam Akujanji dan Tanggungan Rugi ini pada bila-bila masa adalah berasingan dan berbeza di antara satu sama lain. Sekiranya terdapat salahsatu atau lebih daripada mana-mana klausa di dalam Akujanji dan Tanggungan Rugi ini menjadi tidak sah dari segi undang-undang, maka ketidaksahan tersebut tidak sama sekali memberi kesan kepada Klausa-Klausa yang lain.
