The following draft rules further to amend the rules for keeping places of Public Entertainment in Dhule Districts, Which the District Magistrate, Dhule proposes to make in exercise of the powers conferred by clauses (w),(wa) and of sub-section (1) of section 33 of the Bombay Police Act 1951 (Bom xxii of 1951) and all other powers enabling him in that behalf with the previous sanction of the Govt.of Maharashtra is hereby published as required by sub section (6) of the said section 33 of the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the District Magistrate, Dhule after the expiration of one month from the date of its publication in the official Gazette. Any objections or suggestions which may be received by the District Magistrate, Dhule from any person with respect to the said draft before the period aforesaid will be considered by him.

conferred by clauses (w),(wa) and of sub section (1) of section 33 of Bombay Police Act 1951 (Born xxii of 1951) and of all other powers enabling him in that behalf the District Magistrate, Dhule with the previous sanctioned (6) of the said section 33 hereby makes the following rules further to amend the rules for Eating Houses in Dhule as following namely:-

DRAFT RULES RULES FOR KEEPING PLACES OF PUBLIC ENTERTAINMENT IN District Magistrate Dhule 2011 1) (1) Short title - These Rules may be called The Licensing and Controlling of Place of Public Entertainment in Districe Magistrate Rules 20 1 1. (2) It Shall come into force on the date of its publication in the Official Gazette. (3) It extends to the whole of the District Magistrate. B ' k l e .

2) These rules are applicable with retrospective effect to all existing establishments

as well as proposed place of public entertainment

which have been controlled and granted licence by the District Magistrate. 3) Place of public entertainment shall,for the purpose of regulation under the Bombay Police Act,l95 l ,be classified under class "A" and class "B" Class "A" shall comprise a very place of public entertainment in which is sold liquor,today,or any intoxicating drug as defined in the Bombay Prohibition Act 1949. Class "B7'shall comprise every place of public enterainment not comprised in Class "A" 4)

No person shall open or keep a place of public entertainment of

class "A" or class "B" without having previously obtained a licence

No licence to keep a place of Public entertainment of class "A"

shall be granted by the District Magistrate Dhule unless the applicant has previously obtained and produced to the Commissioner of Police of District Magistrate,a licence granted for the same under the Bombay Prohibition Act 1949.

6) i) Every person applying for a licence to keep a place of pubic entertainment shall make an application in form No.1 along with the document specified there in along with three recent photograph of the applicant and shall furnish the following particulars in his application : (a) Name in full (and in case of a Non-Christian,the Father's or Husband's name) (b) Residential address. (c) Age (d) Other occupation, if nay. (e) Full address of the place of a public entertainment for which a licence is applied for giving tenement numbers and the name of the building with house namber and the street or the road where it is situated.

ii) Application Form can be obtained from the licensing authority on paynlent of fees of Rupees 1001-

7) (1) Every person applying for a licence to open or keep a place of public entertainment shall in the first instance satisfy the District Magistrate or any other officer as a case may be being the Licensing Authority that (i) the applicant is suitable (ii) the locality where such place of entertainment is to be opended is fit for the purpose proposed. (iii) that the place proposed to be used as a place of public entertainment is fit for the purpose for which it is proposed to be used. (iv) that the means of entrance and exit to and from the place,are

convenient,easy,sufficient and satisfactory and (v) if the place is in any enclosure,Building tent both or other erection that arrangements regarding ventilation and precaution against fire are suitable and sufficient.

(2) It shall be the condition for every licence that the above provisions of sub-rule ( 1 ) in respect of the place are maintained throughout the period for which the licence is in force. 7-A) No licence under these rules shall be issued unless the person applying for a licence to keep a place of public entertainment affixes his signature,or if he is illiterate,his Left Hand Thumb impression on the licence in the presence befor the Licensing Authority duly countersigned by the Licensing Authority and Draft Rules q

Every such application shall be made in the name of the person in whose name the licence is applied for. ii) Application Form can be obtained from the office of the licensing authority on payment of fees of Rupees 1001-

Every person applying for a licence to open or keep a place

of public entertainment shall in the first instance satisfy the Commissioner of Police or District Magistrate or any other officer as a case may be being the Licensing Authority that (i) the applicant is suitable (ii) the locality where such place of entertainment is to be opened is fit for the purpose proposed. (iii) that the place proposed to be used as a place of public entertainment is fit for the purpose for which it is proposed to be used. (iv) that the means of entrance and exit to and from the place, are convenient, easy, sufficient and satisfactory and (v) if the place is in any enclosure, Building, tent both or other erection that arrangements regarding ventilation and precaution against fire are suitable and sufficient. (2)

It shall be the condition for every licence that the above

provisions of sub-rule (1) in respect of the place are maintained throughout the period for which the licence is in force.
