INSTRUCTION TO TENDERERS REGARDING TENDER FORMS DOWNLOADED FROM INTERNET 1.

Tender file is to be down loaded from the Internet and print out is to be taken on an A4 size paper and details are to be entered by the tendered at the various locations in the document. It is advisable that the downloaded tender document to be printed through high quality printers only. Submission of Xerox or photocopy of tender document is prohibited.

2.

This tender document (in full) down loaded along the various documents required to be submitted as per the tender conditions in a sealed cover duly subscribing with the name of the work, tender notice No. and date, submission of tender downloaded from the internet etc and the same should be dropped in the tender box kept in the office of Dy.CMM(S)/GSD/Raipur before the date and time stipulated in the tender document.

The cost of tender document as indicated in the tender document will have to be deposited by the tenderer in the form of bank draft payable in favour of FA&CAO/SECR/Bilaspur payable at Raipur along with the tender document. This should be enclosed as a separate Demand Draft. A single demand draft for the cost of tender form and Earnest Money Deposit will not be accepted. Tender not accompanied with the demand draft towards the cost of the tender document will be summarily rejected.

The Earnest Money Deposit required for this as stipulated in the tender document also to be submitted separately.

Tenderers are advised to download tender documents well in advance and submit the tender before the stipulated time. It is the responsibility of the tender to check any correction or any modifications published subsequently in website and the same shall be taken into account while submitting the tender, tenderer shall download corrigendum (if any), printout, sign and attach it with the main tender document. Tender document not accompanied by published corrigendum/s is liable to be rejected. The Railway will not be responsible for any postal delays/delay in downloading of tender document from the Internet.

The tenderer may please note that the rate for items should be written in figures and in work by black or blue ball point pen only. Each pages of tender document should be signed by the tenderer.

7.

Tenderer/s are free to download tender document at their own risk and cost for purpose of perusal as well as for using the same as tender document for submitting the offer. Master copy of the tender document is available in the office of the Dy.CMM(S)/GSD/Raipur. After award of agreement will be prepared based on the master copy of the tender document available in the above-mentioned office. In case, any discrepancy between the tender document downloaded from the Internet and the master copy, latter shall prevail and will be binding on the tenderer/s, no claim on this account will be entertained.

8.

If any change/addition/deletion is made by the Tenderer/Contractor and the same is detected at any stage even after the award of the tender, full earnest money deposit will be forfeited and the contract will be terminated at his/their risk and cost. The tenderer is also liable to be banned from doing business with Railways and /or prosecuted.

9.

The following declaration should be given by the tenderer while submitting the tender. To The President of India Acting through the Dy. Chief Material Manager, South East Central Railway/ Raipur. I/We have read the various conditions to tender attached hereto and agree to abide by the said conditions. I/We also agree to keep this tender open for acceptance for a period of 90 (Ninety) days from the date fixed for opening the same and in default thereof. I/We will be liable for forfeiture of my/our “Earnest Money”. I/We offer to do the work for South East Central Railway, at the rates quoted in the attached schedule and hereby bind myself/ourselves to complete the work in all respects within 12 (Twelve) months from the date of issue of letter of acceptance of the tender. I/We also hereby agree to abide by the General Conditions of Contract corrected up-to latest correction slips and to carry out the work according to the special conditions of Contract and Specifications of materials and works as laid down by Railway in the annexed Special Conditions/Specifications and the South East Central Railway General conditions of contract and standard specifications part-IV corrected up-to latest correction slips. Eligibility Criteria The tenderer shall posses the vehicles, which they proposes under this tender registered by competent authority in their name/company or firm’s name/partner’s name or shall have power of attorney of the vehicle in their name/company or firm’s name/partner’s name. The tenderer shall have certificate (i.e. registration (i.e. registration certificate, fitness certificate and insurance policy etc.) of the vehicle. The vehicle owners shall have the permit of local authority for running vehicles for commercial use (Taxi/Maxi certificate). The following document should be submitted along with tender: List of proposed vehicle available on hand (own) and proposed to be inducted (own and hired to be given separately) for the subject work. List of work completed in the last three financial years giving description of work, organization for whom executed, approximate value of contract should also be given. List of work on hand indicating description of work, contract value and approximate value of balance work yet to be done and date of award. Tender form can be obtained on written application from the office of the Dy. Chief Material Manager /S.E.C.Rly/Raipur on production of money receipt of Rs.1000/-(non-refundable& chargeable to Allocation No. Z-652-99) per set with Divl. Cashier, S. E.C Railway/Raipur or any of the station Master of S.E.C. Railway drawn in favour of FA & CAO/SEC Railway Challan form for the purpose of depositing the cost of tender form can be obtained from office of Dy. CMM/GSD/Raipur duly signed. Tender Document will also be available on the website www.secr.gov.in. From the date of publication of NIT. The same can be down loaded and can be used as tender form, but the cost of tender form Should be accompanied in the form of Demand Draft in favour of FA & CAO/SEC Railway, Bilaspur payable at Raipur or the cost of tender form may be remitted with Divisional Cashier SEC Railway, Raipur and money receipt should be attached with tender form. Original Tender papers can be dropped in the tender box available for the purpose in the office of the Dy. Chief Material Manager/GSD/SECR/Raipur up to 15:00hrs on 25.11.2013 and will be opened in public in the office of Dy.CMM(S)/GSD/Raipur at 15:30hrs. of the same date as mentioned above. Tender received after 15:00 hrs on 25.11.2013 will not be considered. Tender received in this office by Registered post only at or before 15:00 hrs on 25.11.2013 will be dropped in the tender box before closure. The Railway Administration will not be responsible for any postal delay to those tenderers who send their tenders by registered post. The Railway Administration has received the right to modify and cancel the tender at any stage without assigning any reasons thereof. In case any of the days herein mentioned above is declared a holiday or bund, on any account the said date shall automatically be substituted by the date of next working day. The tender form is not transferable. Earnest Money can be deposited in cash with the Divl. Cashier/ S.E.C.Railway/ Raipur (and deposit receipt shall be attached with the tender before dropping) or it may be deposited in the form of Bank Deposit such as FDR, STDR, TDR, DD (drawn on Nationalized or Scheduled Bank), etc. duly pledged in favour of FA & CAO/ S.E.C. Railway/Bilaspur payable at Raipur Bank Guarantee Bonds and permanent Earnest Money Deposit are not acceptable. Tender unaccompanied by the requisite Earnest Money in any acceptable form specified above will be in no circumstances entertained and summarily rejected. SOUTH EAST CENTRAL RAILWAY STORES DEPARTMENT TERMS & CONDITIONS OF CONTRACTS (To be signed by the Tenderer and submitted along with the Tender Forms). 1.

Sealed Tenders on prescribed Forms are invited from experienced and financially sound transport contractors and having vehicles registered in their own name for and on behalf of the President of India acting through the Dy. Chief Material Manager of South East Central Railway, Raipur (herein after referred to as the Railway Administration).

2.

Tenders must be enclosed in sealed covers super scribed. Tender must be sent so as to reach this office not later than 15.00 Hrs. on the Opening date mentioned in the Tender Notice or must be deposited in the Tender Box allotted for purpose in this office before 15.00 Hrs. on the Opening Date mentioned in Tender Notice. The Tenders will be opened at 15.30 Hrs. in presence of such Tenderers or their representatives as may be presented. Tenderers are requested to be personally present at the time of opening of tenders.

The Principal item of work is Hiring of Pickup Van for General Stores Depot, Raipur of SECR Covered under Tender (enclosed with this document) as per details in schedule.

4.

The work should be completed within a period of1 12 Months from the date of issue of Letter of Acceptance of the Tender.

5.

Any information relating to the Tender may be obtained from the Office of the DY. Chief material manager, S.E.C. Railway, Raipur on any working day during the office hours. Any information asked for and obtained should be in writing.

6.

Tenders containing ensures and alterations in the Tender documents are to be rejected. Any corrections made by the Tenderer or Tenderers in his/their entries must be attested by him/them.

7.

Tenderers should specifically and fully disclose in their respective constitutions and submit along with their Tenders, attested copies of documents like partnership deed, Articles and Memorandum of Association, Certificate of Incorporation etc. if any in support of such disclosures. If a Tenderer is a Firm (i.e.) in a partnership business, it should be stated whether the same is registered under the Indian Partnership Act, and the names and address of all the partners of the Firm should be fully disclosed. The Railway Administration should always have the liberty to ask for production of the originals of the said documents and also to make such further and other enquiries regarding the constitution of a Tenderer as may be considered necessary from time to time. The tenderer shall furnish the same.

8.

If the Tenderer/ tenderers deliberately give wrong information in his/their tender or creates/create circumstances for the acceptance of his/their tender at any stage. The Railways reserves the right to reject such tender at any stage.

9.

The Tenderers shall be required to deposit the Earnest Money with the tender with the tender form for due performance of the stipulation to keep the offer open for a Period of 90 days from the date fixed for opening the same. It shall be understood that the Tender documents have been sold/issued to the Tenderer(s) and the Tenderer(s) is/are permitted to Tender in consideration of the stipulation on his/their part that after submitting his/their Tender he/they will not resale from his/their offer or modify the terms and conditions there of in a manner not acceptable to the Railway Administration, In case the tenderer(s) fails/fail to observe or comply with the said stipulation, the aforesaid amount is the Earnest money liable to be forfeited by the Railway. “In making such deposits the name of work for which the money is deposited must be clearly stated in writing in favour of FA&CAO/SECR/”

“On no account the Tenderer should send the amount in Government Currency Notes under Insured or registered cover, Govt. Securities (Stock Certificates), Bearer Bonds, Promissory Notes, Cash Certificates other than those specified above) shall not be accepted.” The Earnest Money deposited should be in the form of Fixed Deposit Receipts, Demand Drafts from the Scheduled Banks, Bank Guarantees bonds in the form of earnest money are not acceptable. “No reference to previous deposits of Earnest Money for adjustment against the present Tenders will be accepted.” Tenders submitted with cheques in lieu of Earnest money Deposit receipts will not only be considered for acceptance but will also be summarily rejected. “The Earnest Money of the unsuccessful Tenederers will have as herein before provided, be returned to the unsuccessful Tenderer(s) within a reasonable time but the Railway shall not be responsible for any loss or depreciation that may happen to the security for the due performance of the stipulation to keep the offer open for the period specified or to the Earnest Money while in their possession, nor be liable to pay Interest thereon.” The Earnest Money including the amount taken as Security Deposit for the due performance for the stipulation to keep the offer open till the date specified in the Tender, will be refunded to the unsuccessful, Tenderer/Tenderers within a reasonable time. The Earnest Money deposited by the successful tenderer/tenderers will be retained towards the security deposits for the due and faithful fulfillment of the contract but shall be forfeited if the contractor fails/contractor fail to execute the agreement bond or start the work within a reasonable time (to be determined by the Dy. Chief Material Manager after notification of the acceptance of his/their tender. If his tender is accepted, this earnest money will be retained as part security for the due and faithful fulfillment of the contract in terms of clause-16 of the General Conditions of Contract. The Earnest Money of other unsuccessful tenderers will be returned, to them but the Railway shall not be responsible for any loss or depreciation that may happen there to while in their possession/not be liable to pay interest thereon. No Interest will be paid on the said security when deposited with the Railway. The tenderer whose tender is accepted shall be required to appear the office of Dy. Chief Material Manager, S.E.C. Rly, Raipur in person or if a firm or Corporation a duly authorised representative shall so appear and execute the contract documents within a week’s time after notice that the contract has been awarded to him. Failure to do so shall constitute a breach of the agreement effected by the acceptance of the tender in which case Earnest Money accompanying the tender shall be forfeited by the Railway as liquidated damages for such fault. In the event of any tenderer whose offer is accepted refuse to execute the contract documents as herein before provided by the Railway, the Railway may determine that such tenderer has abandoned the contract and there upon his Tender and the acceptance there of shall be null and void and the Railway shall be entitled, to forfeit the Earnest Money as liquidated damages for such default. Security Deposit: (A) Security Deposit for each work should be 5% of the contract value. (B) The rate of recovery should be at the rate of 10% of the bill amount till the full security deposit is recovered. (C) Security deposit will be recovered only from the running bills of the contract and no-other mode of collecting SD such as SD in the form of instructions like BG,FD etc. shall be accepted towards Security Deposit. Security Deposit shall be returned to the contractors after the physical completion of the work as certified by the competent authority. The competent authority shall normally be the authority who is competent to sign the contract. If this Competent Authority is of the rank lower than JA Grade, then a JA Grade Officer (concern with the work) should issue the certificate. The certificate, inter alia, should mention that the work has been completed in all respects and that all the contractual obligations have been fulfilled by the contractor to Railways against the contract concerned. Before releasing the SD, an unconditional and un irrevocable no claim certificate form the contractor concerned should be obtained. On receipt of the Order form the purchaser by the successful tenderer, the tenderer shall within a period of 21(Twenty One) days from the date of receipt of the Order, deposit Security Deposit in cash with the Divisional Cashier /SECR/Raipur.

AGREEMENT: The successful tenderer/tenderers shall be required to execute an agreement with the President of India acting through the Dy. Chief Material Manager of General Stores Depot of South East Central Railway/Raipur for carrying out the work according to the General Conditions of Contract and Specification for works and materials as given in the specification and the agreement to be executed will be in the Form specified by. Dy. Chief Material Manager, S.E.C. Railway, Raipur for the purpose. The provision contained in the tender papers shall form part of the contract. In any respect about which any of the Provision in the said agreement Form cannot be reconciled to any of the provision in the tender papers, the letter shall prevail. 17. If a tenderer expires after the submission of his tender or after the acceptance of his tender, the Railway shall deem such tender as cancelled. If a partner of a Firm expires after the submission of their tender or after the acceptance of their tender, the Railway shall deem such tender cancelled unless the Firm retains its character. 18.

Non-compliance with any of the conditions set forth here in above is liable to result in the tender being rejected.

19.

It shall be obligatory on the Railway Administration to accept the lowest and no tenderer/tenderers shall deemed any explanation for the cause of rejection of his/their tender.

20.

The authority for the acceptance of the tender will rest with the Dy. Chief Material Manager, SEC Rly, Raipur who does not bind himself to accept the lowest or any other tender.

21.

The Dy. Chief Material Manager/SEC Rly/Raipur reserves to himself the right at any time after acceptance of a tender to keep back from the contractor and carry out in other ways or by other agency for any portion of the work that he may think without giving any notice or reason.

22.

Should a tenderer find discrepancies in, or omissions from any of the tender forms or should be in a doubt as to their meaning he should at one notify the authority inviting tenders who may send a written instruction to all tenderers. It shall be under stood that every endeavor has been made to avoid any error which can materially affected the basis of Tender and the successful Tenderer shall take up in himself and provide for the risk of any error which may subsequently be discovered and shall make no subsequent claim on account thereof.

23.

The work will be carried on a fixed Programme as approved and the method and system of carrying out the works will be described by the Dy. Chief Material Manager, SEC Rly, Raipur or his authorized representative.

24.

The rate quoted is to hold good for acceptance by the Railway Administration for 90 days from the date of opening of tender after which the rate is to be confirmed by both parties before ratifying the contract. The tender submitted will not be revoked or cancelled within the aforesaid period of 90 days. If a tenderer withdrawing his offer during or before the contract period the Earnest Money/ Security Deposit by the tenderer will be forfeited by the Railway Administration and will not be allowed to submit tenders for works in the Stores Department of South East Central Railway, for a period of one year from the date of revocation.

25.

PENALTY : a. In case of failure of the vehicle the arrangement for the alternative vehicle is to be made by the contractor immediately within 60 minutes failing which, no charges will be paid for that day and the contractor shall be penalized with Rs. 500/- per day per vehicle and the penalty shall be deducted from the contractor’s bill. In addition to this penalty, Railway Administration shall have liberty to arrange any other vehicle and the expenditure incurred by the Railway in arranging alternative vehicle will be deducted from the contractor’s bill. Penalty will be imposed, if the vehicle runs anywhere without the permission of executives b. at the rate of Rs. 200/- per occasion per hour & no Km. will be paid.

c.

The contractor shall be liable to be fined up to sum of Rs. 1000/- per vehicle at the sole discretion of the administration for each act of misconduct on the part of the contractor or on the part of any of his/their agents/driver or workmen to observe or to perform any of the terms and conditions of contract, the imposition of any such fine shall not affect but shall be without prejudice to the other rights and remedies of the administration under this agreement or by General Law. Any appeal against such fine shall be made to the Controlling officer of the concerned department, whose decision on the contractor’s appeal shall be final and binding.

d.

Notwithstanding anything contained in the other clauses of the agreement, in the event of unsatisfactory service or any failure/ breach or non-observation at any time by the contractor of the terms and provision of this agreement to the satisfaction of the administration in all respects (which shall be the sole judge and whose decision shall be final), it shall be lawful for the administration without prejudice to all or any other rights and remedies to make any other arrangements it may consider necessary and forthwith terminate this contract without any previous notice to the contractor and in case of such termination the security deposit shall be forfeited by the administration and contractors shall have no claim whatsoever against the administration in consequence of such termination of the contracts.

e.

No Payment will be made for any movement of vehicle not related to Rly purpose that Km will be deducted from Kilometrage.

26.

Waival of Penalty: Dy.CMM(S)/GSD/Raipur can waive off the penalty on proper justification given by contractor for non compliance of any conditions of the contract.

27.

In case of non-acceptance of a tender by the Railway Administration for any reason whatsoever, the Tenderer shall not put any claim the expenses incurred by him in submitting tender for the work, or any other account.

28.

If the work is cancelled before commencement or is terminated during execution in accordance with the prescribed conditions, the Railway Administration reserves the right to invite fresh tenders for the whole or any portion of the work. In case of failure by the contractor the contract will be terminated and fresh tenders will be invited at the risk and cost of the contractor.

29.

Release of Security Deposit: -The Security Deposit for the particular work may be considered for release after successful completion of work.

30.

Variation in Extent of Contract:- In the event of any of the provisions of the contract requiring to be modified after the contract documents have been signed, the modifications shall be made in writing and signed by the Railway and the contractor, and no work shall proceed under such Modifications until this has been done. Any verbal or written arrangement abandoning modifying, extending, reducing or supplementing the contract of any of the terms thereof shall be deemed conditional and shall not be binding on the Railway unless and until the same is incorporated in formal instruments and signed by the Railway and the contractor and till then the Railway shall have the right to repudiate such arrangement.

31. Payments:-The Contractor shall be entitled to be paid every month against bills submitted by the contractor and verification of log book. Dy.CMM(S)/GSD/Raipur shall pass the bills and AFA (W/S)/Raipur shall pay the amount in form of cheque. 32. DISPUTE:-In all matters of dispute the decision of Dy. Chief Material Manager/GSD/SECR/ Raipur shall be final and binding. 33. SUB-LETTING:- The contractor shall not sublet, assign or transfer this contract or any rights or benefits hereunder to any other person or persons, nor shall the contractor take any Partners without the prior written consent of controller of the concerned department.

Contractor should employ only qualified Driver having valid license for four wheels & well experienced in driving. Any change in the staff should also be similarly advised. The contractor is responsible for wages to be paid to the labour engaged by him, the Railway is no way responsible for any damage/loss occurred to the employee by labour engaged by the contractor during execution of work on Railway administration is not in any way responsible for payment of compensation etc., whatsoever. Performance Guarantee:The Performance Guarantee is outlined below :(a) The successful bidder should give a Performance Guarantee in the form of an irrevocable bank guarantee amounting to 5% of the contract value,(This is in addition to the security Deposit. (b) The Performance Guarantee should be furnished by the successful contractor after the letter of acceptance has been issued, but before signing of the agreement and should be valid up to expiry of the maintenance period. The agreement should normally be signed within 15 (Fifteen) days after the issue of LOA and Performance Guarantee should be also be submitted within this time limit. (c) Performance Guarantee shall be released after satisfactory completion of the work and maintenance period is over. The procedure for releasing should be same as for Security Deposit, (d) Wherever the contracts are rescinded, the security deposit should be forfeited and the Performance Guarantee shall be encashed and the balance work should be got done separately, (e) The balance work shall be got done independently without risk and cost of the original contractor, (f) The original contractor shall be debarred from participating in the tender for executing the balance work. If the failed contractor is a JV or a partnership firm, then every member /partner of such a firm would be debarred from participating in the tender for the work either in his/her individual capacity or as a partner of any other JV/partnership firm.

SPECIAL CONDITIONS OF CONTRACT The hired vehicle will have to perform all the work of transportation of Materials, Railway officers and staff in Chhattisgarh area, to and fro and also as and when required, including Sundays and holidays as notified by the Railway Administration from time to time at the discretion of Railway for the period of 12 (Twelve) months subject to the following terms and conditions:1

In case of failure of the vehicle the arrangement for the alternative vehicle is to be made by the contractor immediately within 60 minutes failing which, no charges will be paid for that day and the contractor shall be penalized with Rs. 500/- per day per vehicle and the penalty shall be deducted from the contractor’s bill. In addition to this penalty, Railway Administration shall have liberty to arrange any other vehicle and the expenditure incurred by the Railway in arranging alternative vehicle will be deducted from the contractor’s bill.

The contractor shall be liable to be fined up to sum of Rs. 1000/- per vehicle at the sole discretion of the administration for each act of misconduct on the part of the contractor or on the part of any of his/their agents/driver or workmen to observe or to perform any of the terms and conditions of contract, the imposition of any such fine shall not affect but shall be without prejudice to the other rights and remedies of the administration under this agreement or by General Law. Any appeal against such fine shall be made to the Controlling officer of the concerned department, whose decision on the contractor’s appeal shall be final and binding.

Notwithstanding anything contained in the other clauses of the agreement, in the event of unsatisfactory service or any failure/ breach or non-observation at any time by the contractor of the terms and provision of this agreement to the satisfaction of the administration in all respects (which shall be the sole judge and whose decision shall be final), it shall be lawful for the administration without prejudice to all or any other rights and remedies to make any other arrangements it may consider necessary and forthwith terminate this contract without any previous notice to the contractor and in case of such termination the security deposit shall be forfeited by the administration and contractors shall have no claim whatsoever against the administration in consequence of such termination of the contracts.

It will be the entire duty/responsibility of the contractor only to enforce Regulations/compliance of labour laws, hours of employment, Insurance and any other Act/provision etc. enforced from time to time. South East Central Railway will be using the vehicle as a passenger only. Hours of employment regulation: - The contractor shall be responsible for compliance with the provision of the hours of employment regulation in respect of the staff employed by him in the manner decided upon by the appropriate authorities. The contractor shall not sublet, assign or transfer this contract or any rights or benefits hereunder to any other person or persons, nor shall the contractor take any partners without the prior written consent of controller of the concerned department.

The contractor in addition to the indemnity provided by law shall indemnify the Railway administration against all liability whatsoever to pay compensation under Workmen Compensation Act 1923 as amended from time to time in respect of any accident/injury to any labour employed by him under this contract or compensation in respect of any claim arising out of or in the course of employment under this contract.

The contractor shall comply with the provision of Payment of Wages Act and the Minimum Wages Act or any other rules made there under as amended from time to time in respect of all employees employed by him in connection with this contract.

The contractor further agrees to keep the Railway administration indemnified against any and every other losses, damages by reason of the operation of this contract or by reason of any neglect default act or omissions on the part of the contractor or his workmen suffered by to any property of the Railway administration and or by or to any property of any other person lying or being on premises belonging to the Railway administration.

The vehicles will run mostly in Chhattisgarh state and outside area, whenever needed.

At the end of every calendar month, the contractor shall submit his bills in quadruplicate along with Xerox copy of Log Book of relevant period within ten days of the end of each calendar month to the controlling officer of the particular department, who in turn shall verify and forward the bills to AFA (W/S)/Raipur along with penalty statement, if any. Payment will be arranged by cheque or by EFT at the discretion of the Railway administration.

The contractor agrees for recoveries being made by the Railway administration from his monthly bills or security deposit, of the contract from any other amount due to him on account of payments made to the contractor, through any advertent whatsoever.

In case of the recoveries to be made, exceeds the security deposit, the contractor shall further make good the deficiency in cash within 5 days of the date of demand to this effect.

No alteration is allowed in the agreement unless entered through subsidiary agreement signed by both the parties.

The work to be undertaken by the contractor under the provisions of this contract conditions shall at all times and from time to time be carried out to the entire satisfaction of the Railway administration. Any failure on the part of the contactor to carry out work in such a manner shall constitute a breach of contract on the part of the contractor.

The vehicle is proposed to be hired on monthly rate basis for a period of 12 (Twelve) months with the condition that contract can be terminated at any time by giving 15-days notice.

The vehicle will generally run during day time duty hours, however, the vehicle may be used during night time also, if needed

Taxes will be deducted as declared/enforced by the State Government and Central Government time to time.

Any claim, compensation arising out of any accident/injury to any person/party will be the liability of contractors and/or any litigation arising out of running/accident of vehicle or due to the person employed by the contractor etc. shall be dealt by contractor himself at his own cost. Railway will not bear any liability on any account.

The following definitions shall be applicable for the purpose of this tender: a) Day means a calendar day starting from 00 hours to 24 hours. b) Vehicle shall mean the vehicle specified as per scope of work. The vehicle shall have registration of Chhattisgarh only.

The Railway reserves the right to terminate the contract at any time without assigning any reason thereof by giving 15-days notice in advance. The contractor shall not be entitled for any compensation in case of such termination.

The vehicle shall not be older than 4 years from the date of opening of tender. If any vehicle is found running older than that, then a penalty will be imposed at the rate of Rs.1000/- per day per vehicle for number of days older vehicle used.

The contractor shall quote monthly rate of hire of the vehicle. The rate shall be deemed to be inclusive of the following: i)

All maintenance expenditure of vehicle i.e. major and minor repairs required for good running of the vehicle, lubricants, all consumables.

ii)

Rate shall include the Driver’s salary, all types of taxes and fees payable to RTO department, Labour authorities, local & municipal authorities, taxes, levies, fees, toll taxes and all other charges, which are necessary for the continuance of the service under the contract.

iii)

Rate shall include hiring of vehicle for 12 hours in a day.

iv)

Any other charges required for execution of this contract except as laid down in Tender Schedule.

Vehicle shall be attached with the officers/staff of GSD, Raipur, SEC Railway, as per the instruction of authority, floating this contract and can be changed as and when required by him only, which shall be informed in writing all the time.

One weekly off is permitted to the Driver normally on Sundays. However, it may be deferred to some other day at the discretion of officer in charge to whom the vehicle is attached.

Normal duty of driver shall be for 12 hours in day. The officer concerned shall advise normal working hours to the Driver. The Driver of the vehicle shall keep himself in contact with the officer in charge.

The vehicles may have to go the sites of all types including Kachcha road etc. The vehicle shall also be required to go along the Railway embankment for approaching any desired Km or site. Any excuses about condition/existence of the road will not be accepted.

Contractor shall maintain a Log Book in specified format which shall be signed jointly by the Driver and the officer in charge. It will be the sole responsibility of the Driver that log-book is filled up daily and there is no cutting/overwriting. If there is any cutting/overwriting, the same shall be attested by the officer in charge using the vehicle. Columns for opening meter reading “in the morning” and closing meter reading “in the evening” must be kept in the log book in addition to other columns. The Driver shall ensure that the vehicle is always having sufficient fuel in all the time.

The user shall nominate a stable place preferably a shed/garage near to his residence in Raipur Municipality or office, where the vehicle is required to be stabled during the off days/off hours. The contractor may take the vehicle to his garage/shed during off hours/off days for which no payment shall be made for running of vehicle beyond the said nominated place. In the day of the use of vehicle, the km for the day shall start when the driver shall report with the vehicle at the place nominated by the user near to his residence or office within Raipur Municipal area. Similarly, the end km of the day shall be at such nominated place near his office or residence. For this purpose only, special columns for meter readings “in the morning” and “in the evening” are to be maintained in the log book, as stated in above clause. No extra payment shall be made for the movement of the vehicle if taken by the contractor or driver for repair and any other purpose of the contractor. In case the vehicle is stabled in the shed/garage/portico or any other nominated place as advised by the user, the vehicle shall remain under the custody of the driver only and railway shall not bear the loss/damage to the vehicle during such period.

The contractor shall ensure that all the meters particularly the Kilometer/Speedometer and other devices of vehicle are always in working condition. In case, if the Railway’s authority points any defects, the contractor at his own cost shall immediately rectify the same. And in the meantime, the contractor shall arrange another vehicle so that the Railway’s work does not get hampered. If the meter goes out of order, the reading given by the officer shall be the final and binding on the contractor.

To avoid any mishap or accident during the operation of the vehicle, the contactor shall ensure that only skilled staff with sufficient experience in their respective trade are deployed on job and are not put to over exertion as per labour laws.

The contractor shall provide a spare wheel and necessary tools in a good working condition.

In the event of the break down of the vehicle en-route responsibility of transporting the incumbent of the vehicle to his destination shall be borne by the contractor. The contract shall be governed by the General Conditions of Contract.

The contractor shall possess the vehicles which he proposes under this tender/contract registered by competent authority in his name/company or firm’s name/partner’s name or shall have a power of attorney of the vehicle in his name/company or firm’s name/partner’s name.

The tenderer shall be required to submit papers, certificate (i.e. registration certificate, fitness certificate and insurance policy etc.) of the vehicles for verification by this office. Private vehicle shall not be accepted. Vehicle shall be passed in TAXI/MAXI quota.

The drivers put on the job by the contractor must always possess valid driving license, registration papers, road tax paid receipts, interstate permits etc.

The Driver/staff provided with the vehicles must be physically/medically fit, professionally and legally competent in all respects, holding valid license prescribed under prevailing Motor Vehicles Act and Rules.

The vehicles deployed on the job should be fit in all respects for operation in accordance with prevailing Motor Vehicles and Act and Rules, amended form time to time and all their relevant valid RTO documents like RC book, Insurance certificate, fitness certificate etc. must be available with the taxes, levies, fees etc. paid up to date. The contractor shall be exclusively and solely responsible for any lapse in this regard and Railway stands completely indemnified by the contractor against such defaults.

The contractor shall be liable to honor Central and State Govt. laws, statutory rules, regulations, notifications like legislation, local self-Govt./Municipal requirements etc. and shall be solely responsible for any breach thereof. Railway stands indemnified against any penalty/prosecutions consequent to the violations (deliberate or inadvertence) by the contractor or his employees, representatives etc. of such statutory provisions in force.

The contractor shall indemnify the Railway against any or all claims, which may arise under the Motor Vehicles Act or Workman’s Compensation Act or any other act or Stature having bearing over the services and for engagement of workmen, directly or indirectly for performance of work under the contract.

The contractor shall indemnify the Railway and its employees against any penalties as PRINCIPAL EMPLOYER, for any failure of the contractor to honour various Central/State Government laws/enactments.

The quantities shown in the schedule are approximate and meant to give the tenderer/s an idea of the quantities of work involved. The Railway reserves the right to add/delete any item/s and to increase/decrease the quantities by 25%, if the hiring is on open tender basis. The contractor shall not be entitled to any extra payment on account of any such excess/deduction in quantities arbitrarily but will be paid at the accepted contracted rates for the actual quantum of work done.

First Aid Box with all necessary consumable items should be made available all the time by the contractor and periodically he/they should inspect and recoup the same and necessary entry should also be made in Log Book. The drivers and passengers safety belts should also be provided by the contractors. Damaged, broken and over-aged belt should also be replaced by the contractor. The tenderer/contractor should submit the certificate regarding the calibration of speedometer as and when demanded by the concerned officer using the vehicle. The vehicles supplied should be neat, clean and in good fettle. The drivers should have proper/valid license and must be well dressed and in uniform. Drivers should not consume alcoholic drinks while on Railway duty and should be polite in behavior.

The tenderer must get him or his firm registered as Taxi service provider with department of custom and central Excise within one month time from the date of award of the work.

The quoted rates are firm and no price variation clause will be applicable during the currency of the contract or even during extended period.

For late reporting of the vehicle, administration reserves the right to levy a fine of Rs 200/- per day. Unless otherwise specified in the special conditions. If any, the Security Deposit /rate of recovery/mode of recovery shall be as under:-

The contractor shall ensure that no inconvenience is caused to any of the occupants of the work premises.

Hours of Employment Regulation: The contractor shall be responsible for compliance with the provision of the hours of employment regulation in respect of the staff employed by him in the manner decided upon by the appropriate authorities.

The vehicle drivers nominated by the contractor should have a license to drive the vehicle as per the extent provisions of the Government. He/they should have thorough knowledge on traffic regulations, road rules etc. as related with driving of road vehicles.
