Students should also read Federal Rules of Evidence sec. 401-403 and Calif. Evidence Code sec. 210 and sec. 352. These rules are available in the appendices to the casebook. Introduction to the Equal Protection Clause: The "Rational Basis" Test 1) Please read the Chemerinsky casebook, pp. xxxv to xxxviii (Preface); pp. 717-730 (Equal Protection). 2) Also, please read the attachment, PERRY v. BROWN (Proposition 8 Ninth Circuit Court of Appeals decision), pp. 42-55 (discussing the ROMER v. EVANS case). The Perry v. Brown attachment can be found on the First Class Assignments page.

Optional: If you need further background on this famous case, currently pending before the Supreme Court, read pp. 1-20 of the Ninth Circuit opinion for a little background.)
